What is a private cannabis club?

A private cannabis club is a members-only venue — a private membership arrangement that admits members rather than the public, so access is by membership, not a walk-in purchase. Their legal position in South Africa is unsettled and has been tested by police action and litigation: the 2018 Constitutional Court judgment protects private, personal cultivation and use in a private place, and no court has held that membership makes lawful anything that would otherwise not be. Rules and requirements vary by club and change over time, so always check current requirements with the club before you go.

How to join a club

Dagga is not legal in South Africa in the way that word is usually meant, and it is not simply illegal either. Before you look for private cannabis clubs in South Africa, know what the law protects and what it still punishes. Law stated as at 20 August 2026.

What the law actually protects

An adult may use or possess cannabis in private, and may cultivate it in a private place, for personal consumption in private. On 18 September 2018 the Constitutional Court decided Minister of Justice and Constitutional Development v Prince and held exactly that, striking down the offending provisions of the Drugs and Drug Trafficking Act 140 of 1992 and the Medicines and Related Substances Act 101 of 1965 to that extent. That judgment is still the operative law.

The protection is narrower than the word "legal" suggests. It does not create a market or a permit to supply other people. South Africans mostly say dagga. They also say weed, zol and ganja. The word changes with the speaker; the legal boundary does not.

How people actually get dagga here

Growing your own is the route the judgment actually protects. Private cultivation for an adult's personal consumption in a private place falls within the protection recognised in Prince, provided it stays personal — it is not a general permission to grow for customers, friends, members or a delivery operation.

There is no lawful counter anywhere in the country: no dispensary, no coffeeshop, no online store and no delivery service that may lawfully sell to you. Where private clubs sit

Private cannabis clubs exist across South Africa, and their legal position is unsettled. They are private membership arrangements, tested both by police action and by litigation. No court has held that membership of a club makes lawful anything that would otherwise not be, and a membership fee does not convert a supply into a private act.

There is no quantity to quote, and the 2024 Act is not in force

The Court fixed no quantity, and none has been enacted since. Whether what you hold counts as personal is judged on the facts, first by the officer in front of you and then by a court. Every figure circulating on the South African internet comes from a draft that never commenced.

The Cannabis for Private Purposes Act 7 of 2024 was signed into law and it is not in force. Section 8(1) provides that it comes into operation on a date fixed by the President by proclamation in the Gazette, and no such proclamation has been issued. What is still a crime

What remains a crime is the part that gets people arrested, and it has not changed. Dealing is an offence. Use or possession in public is an offence. Supplying cannabis to a child is an offence. Driving while under the influence is an offence under the National Road Traffic Act 93 of 1996, and there is no per-se nanogram threshold in force, so impairment is proved the ordinary way.

A private setting does not travel with you. What is private inside a venue is not private on the pavement outside it, and a club's own policies cannot override an Act of Parliament or a court ruling. The rest is in is dagga legal in South Africa?
