成年人私下使用大麻不构成刑事犯罪，但买卖仍然是犯罪行为。2018年，宪法法院在Minister of Justice v Prince一案中裁定，成年人在私人场所为个人消费而使用或持有大麻，或为此目的在私人场所种植大麻，均不构成犯罪。贩卖行为未受影响，仍然违法。以上内容为一般性信息，不构成法律意见。法律状态截至2026年8月20日。

《Cannabis for Private Purposes Act》（《大麻私人用途法》）是什么？

我可以在公共场所使用大麻吗？

烟具店和CBD商店实际上在卖什么？

它们卖的是吸食用具和CBD产品——不是大麻。出售大麻花是贩卖行为，仍属刑事犯罪，无论墙上挂着什么证书都不例外；药品监管机构已公开警告，种植许可证或出口许可证并不能授权商店出售大麻。CBD只能在很窄的限额内非处方购买，超出这个范围就需要处方。至于商店里出售的其他商品，我们只发布商店自己提供的信息，不对其是否合法作出评价。
