## Can a club grow cannabis for you in South Africa? The short answer

A club growing cannabis on your behalf is not protected by the Prince judgment, and a South African court has held that the model amounts to dealing. That is the single most important thing to understand about how cannabis clubs work in South Africa, and it is why the clubs in this directory are private clubs rather than suppliers. Law stated as at 20 August 2026.

**The direct answer is no** on the authority that currently exists. If a club takes responsibility for [cultivation](/guide/growing-your-own-cannabis "Growing Dagga at Home | SA Social Clubs") and promises to return cannabis to you, describing you as the owner of particular plants does not by itself make the arrangement personal cultivation.

**This is a legal distinction, not a comment on a club's advertising**. The question is what the arrangement does in substance: who cultivates, where the cultivation happens, who pays, and how the harvest reaches the member.

## How the grow club model was supposed to work

The grow club model works like this. A member pays a club. The club germinates and cultivates plants at its own premises, the member is described as the owner of specific plants, and the club acts as cultivator on the member's behalf. The harvest is then returned to the member. The argument is that the member is only ever growing their own cannabis and has merely delegated the labour of doing so.

The model is attractive to adults who rent, live under complex conduct rules, lack suitable space, or do not have the practical skill to cultivate at home. Those circumstances may explain why someone looks for a club, but they do not change the legal character of a cultivation arrangement.

**Calling the service cultivation-by-proxy does not answer the legal question**. A contract, membership record, plant label, or internal allocation may describe the relationship in a particular way, but the court examined the operation as a whole.

**Membership also does not automatically create a right to receive cannabis**. A person considering a club should separate ordinary membership services and information from any promise that another party will cultivate, store, or deliver cannabis for them.

## What the court held in The Haze Club case

That argument was tested and it lost. In The Haze Club (Pty) Ltd and Others v Minister of Police and Others (2101/2021) \[2022\] ZAWCHC 269, reported as \[2023\] 1 All SA 280 (WCC), the Western Cape Division of the High Court handed down judgment on 29 August 2022 and held that operating the grow club model is tantamount to dealing in cannabis. The court's reasoning went to what Prince actually protected: cultivation by an adult, in a private place, for that adult's own personal consumption in private. A commercial operation cultivating at its own premises, for payment, for many members at once, is not that, and relabelling the transaction as agency does not change what is happening.

**The authority is The Haze Club (Pty) Ltd and Others v Minister of Police and Others**, not a case against the Minister of Justice. Its citation and respondent name matter because the legal proposition depends on identifying the actual judgment accurately.

The relevant protection from Minister of Justice and Constitutional Development v Prince concerns an adult's own private cultivation and private consumption. It does not turn a business that cultivates at its own premises for paying members into the member's personal activity.

**The holding was that the grow club operation is tantamount to dealing in cannabis**. That is the point a reader needs to test against any claim that the judgment had no effect on clubs or that paperwork alone removes the problem.

## Why the appeal never settled the question

The appellate history matters, and it is usually reported wrongly in both directions. Leave to appeal to the Supreme Court of Appeal was granted, so the matter was headed for a court that could have settled the question for the whole country. It never got there. The appellants reached an out-of-court settlement with the State and withdrew the appeal, and the terms of that settlement are confidential. The consequence is precise: the High Court judgment was never overturned, and it was also never tested on appeal. It stands undisturbed as a decision of the Western Cape Division, binding there and persuasive elsewhere, and the question has not been settled nationally by a higher court.

**Leave to appeal was granted, but no appellate judgment followed**. The appeal was withdrawn after the appellants reached a confidential out-of-court settlement with the State.

That means two commonly repeated descriptions are both wrong. The judgment was not overturned, and the settlement did not declare the grow-club model lawful or reopen it as a vindicated arrangement.

**The position is therefore neither a national declaration of illegality nor a national clearance**. The High Court judgment remains undisturbed as a Western Cape Division decision: binding in that division and persuasive elsewhere, while the national question remains unresolved by a higher court.

## What this means for clubs and their members today

So the honest answer to whether a club may grow cannabis for you is no, on the authority that currently exists. Anyone presenting the settlement as a victory that reopened the question is reading a withdrawal as a win.

For this question the short version is that a club is a members' organisation and not a supply channel. A club that offers to grow for you, to hold your plants, or to hand you a harvest in exchange for a fee is offering the model a court has already called dealing, and the criminal exposure sits with everyone involved, members included.

**A member should not assume that the club's structure protects the member**. The judgment's reasoning concerns the arrangement as operated, so a person joining or remaining in a cultivation-by-proxy arrangement should understand that membership is not a substitute for personal cultivation.

**Promises about ownership, allocation, or a later handover deserve careful scrutiny**. They may be presented as evidence that the cannabis belongs to the member, but they do not erase the fact that the club is cultivating at its own premises on behalf of another person.

The legal position also matters to people who have already joined such an arrangement. This page does not decide anyone's individual criminal liability, but the court's holding means that members should not treat a club's confidence, branding, or contract wording as proof that the model is protected.

## What an adult may still lawfully do

What remains lawful for an individual is unchanged, and it is genuinely broad: an adult may cultivate cannabis in a private place for personal consumption in private. The protection is personal. It does not extend to growing for another adult, and it cannot be delegated to a company.

**The lawful route described by the Prince judgment is personal cultivation in a private place for personal private consumption**. It is not a general permission for a business, club, or company to cultivate on behalf of members.

An adult who cannot grow at home because of a lease, complex rules, lack of space, or lack of experience may find the practical position frustrating. Those barriers do not create a legal entitlement to have another party perform the cultivation for them.

**Private cultivation and cultivation for someone else are different activities**. A club may describe itself as acting as an agent, but agency language cannot transfer the personal nature of the protection to a separate operator.

## What the Cannabis for Private Purposes Act changes right now

The [Cannabis for Private Purposes Act](/guide/cannabis-for-private-purposes-act "The Cannabis Act 7 of 2024 | SA Social Clubs") 7 of 2024 does not resolve this. It was signed into law and it is not in force, because section 8(1) provides that it comes into operation on a date fixed by the President by proclamation in the Gazette and no such proclamation has been issued. Nothing that is said about the Act's eventual treatment of clubs is law today.

**The Cannabis for Private Purposes Act 7 of 2024 is signed but not in force**. Section 8(1) requires a proclamation fixing its commencement date, and no such proclamation has been issued as at 20 August 2026.

That distinction is important when a club points to future legislation, proposed interpretations, or an expected regulatory position. Future treatment cannot be used as present authority for a model that the existing High Court judgment held amounts to dealing.

**Do not read commentary about the Act as current law**. The relevant legal position on this page is the law stated as at 20 August 2026, including the undisturbed High Court judgment and the absence of an appeal decision.
